Terms and Conditions
Please read these terms carefully before accessing or using the Kego Marketplace. By creating an account or placing an order, you agree to be bound by these provisions.
1. Acceptance of Terms
By creating an account, downloading our mobile application, or accessing any part of the Kego Platform (including www.kegoshop.com, console portals, and APIs), you ("User", "Buyer", or "Vendor") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the Platform.
2. Eligibility & Account Security
2.1 Age Requirement: You must be at least eighteen (18) years old or the legal age of majority in your jurisdiction to form a binding contract.
2.2 Account Accuracy: You agree to provide accurate, current, and complete registration information. You are strictly prohibited from using fake identities or impersonating other individuals or entities.
2.3 Account Security: You are responsible for safeguarding your login credentials, Two-Factor Authentication (2FA) tokens, and numeric Transaction PIN. Any transaction authorized via your valid password, 2FA code, Google OAuth session, or Transaction PIN will be deemed executed by you. You must notify Kego immediately at support@kegoshop.com if you suspect unauthorized access.
3. The Kego Marketplace Model
3.1 Platform Nature: Kego operates an online multi-vendor marketplace connecting independent third-party sellers ("Vendors") with consumer and business purchasers ("Buyers").
3.2 Contract of Sale: Unless explicitly stated otherwise, Kego is not the manufacturer, primary seller, or distributor of goods listed on the platform. The legal contract of sale is formed directly between the Buyer and the Vendor.
3.3 Escrow Protection: To protect both parties, Kego provides an automated escrow payment processing service. Payments made by Buyers are held securely in escrow and released to the Vendor only upon confirmed delivery or the expiration of the dispute inspection window.
4. Buyer Terms, Wallet & Order Placement
4.1 Order Acceptance: Placing an order constitutes an offer to purchase. An order is accepted when the payment is confirmed and the Vendor acknowledges order fulfillment.
4.2 Digital Wallet: Buyers are provided a digital marketplace wallet balance for checkout convenience, deposit funding, and instant dispute refunds. Wallet balances do not earn interest and are non-transferable between users outside authorized marketplace transactions.
4.3 Transaction PIN: Buyers may be required to enter their 4-to-6 digit numeric Transaction PIN to authorize checkout, wallet debits, or payment confirmations.
4.4 Geographic Delivery Restriction: Marketplace delivery services are currently provided exclusively within the Federal Capital Territory (FCT), Abuja, Nigeria under our rapid delivery commitment. Orders with destination addresses outside Abuja will be rejected or cancelled with full refunds to the Buyer's Kego Wallet.
5. Vendor Onboarding, KYC & Store Operations
5.1 Vendor Verification (KYC): All Vendors must successfully pass our Know-Your-Customer (KYC) compliance verification before their store is activated for sales. Required documentation includes valid government-issued ID, proof of business address, CAC registration, and bank verification. Kego reserves the right to suspend or revoke KYC status at any time if fraudulent documentation or misrepresentation is detected.
5.2 Catalog Integrity: Vendors warrant that all product titles, descriptions, images, prices, variations (color, size), and stock levels are truthful, accurate, and not misleading.
5.3 Sales Commission & Payouts: Kego charges a platform commission on each completed transaction, deducted automatically prior to payout disbursement. Payouts are credited to the Vendor's verified account following successful order delivery, subject to our standard holding and clearance period of seventy-two (72) hours to account for customer inspection, disputes, or chargebacks.
6. Escrow Mechanism, Inspection & Dispute Resolution
6.1 Funds in Escrow: When a Buyer pays for an order, the purchase amount is deposited into an escrow account. Funds are released to the Vendor only when:
- The Buyer confirms receipt and satisfaction via the Platform; OR
- The order tracking indicates confirmed delivery and the standard inspection period of seventy-two (72) hours elapses without a dispute being filed.
6.2 Filing a Dispute: If an item is not delivered, is delivered damaged, is defective, or significantly differs from the seller's listing, the Buyer must open a formal Dispute via their Order Dashboard within the 72-hour inspection period with supporting photo/video evidence.
6.3 Dispute Resolution Process: Kego's Dispute & Compliance team acts as a neutral arbiter. If the dispute is resolved in the Buyer's favor, escrow funds will be refunded to the Buyer's Kego Wallet. If the dispute is determined to be abusive or invalid, funds will be released to the Vendor. The determination of Kego's Dispute & Compliance department is final.
7. Intellectual Property
7.1 Kego IP: The Kego name, trademarks, logos, UI designs, codebases, software, and databases are the exclusive property of Kego Technologies Limited.
7.2 Prohibited Goods / Counterfeits: Vendors are strictly forbidden from selling replica, knockoff, or counterfeit goods. Kego will immediately remove infringing listings and suspend vendor accounts upon receiving valid infringement notices.
8. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis without warranties of any kind. Kego does not manufacture, inspect, or guarantee individual products listed by third-party Vendors. In no event shall Kego's total aggregate liability arising out of or related to your use of the Platform exceed the total amount paid by you in the specific transaction giving rise to liability.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute that cannot be resolved through informal negotiations shall be submitted to binding arbitration in Abuja, Nigeria.
